Benjamin C. Rosenbaum is a California-licensed attorney from Fresno, California. He received his undergraduate degree from Fresno Pacific University, and his Juris Doctor from the University of California, Davis.

Benjamin provides services to schools, colleges, and universities for discrimination, harassment, sexual misconduct, and Title IX matters, including:
- Neutral Hearing Officer for formal Title IX and non-Title IX hearings.
- Assisting in the creation of a hearing script and logistics planning.
- Collaborating with administrators and legal counsel to ensure hearing process and procedures comply with Title IX requirements and applicable policies.
- Conducting the hearing, including the questioning of parties and witnesses.
- Making determinations regarding relevancy and admissibility.
- Issuing a thorough and thoughtful decision, aligned with applicable law and policy.

- Issuing detailed and legally compliant written decisions based upon investigation reports in situations where a hearing is not required.

Bio
Since 2012 Benjamin has focused on representing educational organizations, including K-12 districts, community colleges, and universities. He provides legal advice and guidance regarding student matters, labor and employment issues, civil rights compliance, school district organization, elections, real estate, and business and facilities matters. Benjamin also has extensive experience handling a variety of complaint and investigation processes, including general personnel, sexual harassment and discrimination, bullying, retaliation, the California Uniform Complaint Procedures, Department of Education, Office for Civil Rights (“OCR”) complaints (Title II and Title IX), and employee complaints under Title VII.
He brings all of this experience to bear in his provision of hearing officer, decision-maker, and appeal adjudicator services for Title IX complaints. Benjamin is skilled at handling complex and contentious multiday live hearings, and issuing thoughtful decisions with understanding and respect.
Benjamin’s services are also informed by his broad and varied legal career outside of education law, which includes business litigation and transactional work for corporate clients, real estate matters, litigating constitutional law cases involving First Amendment claims, and advising nonprofit organizations.
